Welcome to Enduro Book. By accessing or using our platform, mobile application, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and Enduro Book ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

Enduro Book is a platform designed for the mountain biking and enduro racing community. Our Service provides:

  • Event discovery, registration, and management for enduro and mountain biking events
  • Rider, spectator, and event organizer account types with tailored features
  • GPS tracking and live event monitoring capabilities
  • Community features for riders, spectators, and event organizers
  • Results tracking, leaderboards, and performance analytics

3. Account Registration and Types

3.1 Account Creation

To access certain features of the Service, you must create an account. You may register using:

  • Email and password (credentials-based authentication)
  • Third-party authentication providers (currently Google OAuth, with additional providers planned)

3.2 Account Types

Enduro Book offers three account types:

  • Rider Accounts: For participants in enduro and mountain biking events
  • Spectator Accounts: For fans, family, and friends who wish to follow events and riders
  • Event Organiser Accounts: For clubs and organizations hosting enduro and mountain biking events

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Providing accurate, current, and complete information during registration

You must be at least 13 years old to create an account. Users under 18 should have parental or guardian consent.

4. User Conduct and Prohibited Activities

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation
  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Upload or transmit viruses, malware, or any malicious code
  • Attempt to gain unauthorized access to any portion of the Service
  • Harvest or collect information about other users without their consent
  • Use the Service for any commercial purpose without our prior written consent

4.2 Content Guidelines

When posting content, participating in events, or interacting with other users, you must not:

  • Post content that is defamatory, obscene, pornographic, or offensive
  • Harass, bully, or threaten other users
  • Post spam, advertisements, or promotional content without authorization
  • Infringe on intellectual property rights of others
  • Share false or misleading information about events, results, or other users

5. Event Participation and Safety

5.1 Assumption of Risk

Mountain biking and enduro racing are inherently dangerous activities. By participating in events listed on our platform, you acknowledge and accept the risks involved, including but not limited to:

  • Physical injury or death
  • Equipment failure or damage
  • Environmental hazards and unpredictable terrain
  • Collisions with other riders, obstacles, or wildlife

5.2 Participant Responsibilities

If you are a rider participating in events:

  • You must ensure you are physically fit and properly trained
  • You must use appropriate safety equipment as required by event organizers
  • You must follow all event rules, regulations, and marshal instructions
  • You are responsible for your own insurance coverage
  • You must accurately represent your skill level and experience

5.3 Event Organiser Responsibilities

Event organizers are responsible for:

  • Ensuring events comply with all applicable laws and regulations
  • Obtaining necessary permits, permissions, and insurance
  • Providing accurate event information, including difficulty ratings and requirements
  • Implementing appropriate safety measures and emergency procedures
  • Clearly communicating event rules, hazards, and requirements to participants

6. GPS Tracking and Location Services

Our Service may include GPS tracking features for event monitoring and safety. By using these features, you consent to:

  • The collection and transmission of your location data during events
  • The display of your location to event organizers, spectators, and other authorized users
  • The storage of location data for results tracking and analytics

You may disable GPS tracking features, but this may limit your ability to participate in certain events or access specific features.

7. Intellectual Property

7.1 Our Content

The Service and its original content, features, and functionality are owned by Enduro Book and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

By posting content to the Service (including photos, comments, event results, or other materials), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to post your content and that your content does not violate any third-party rights.

7.3 Trademarks

"Enduro Book" and our logos are trademarks of Enduro Book. You may not use our trademarks without our prior written permission.

8. Payment and Refunds

8.1 Event Fees

Event registration fees, if applicable, are set by event organizers. By registering for a paid event, you agree to pay all applicable fees.

8.2 Refund Policy

Refund policies are determined by individual event organizers. We facilitate payment processing but are not responsible for refund disputes between participants and event organizers.

8.3 Platform Fees

We may charge fees for certain premium features or services. All fees will be clearly disclosed before you commit to a purchase. Fees are non-refundable unless otherwise stated.

9. Third-Party Services

Our Service may integrate with or contain links to third-party services, including:

  • OAuth authentication providers (Google, and potentially Facebook, Apple, etc.)
  • Payment processors
  • Mapping and GPS services
  • Social media platforms

We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and conditions.

10. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is described in our Privacy Policy (see footer link), which is incorporated into these Terms by reference.

By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • Results obtained from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations
  • Any errors in the Service will be corrected

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENDURO BOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use of or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Service
  • Injuries, accidents, or damages sustained during participation in events listed on our platform

11.3 Indemnification

You agree to indemnify, defend, and hold harmless Enduro Book, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your participation in events listed on the platform

12. Account Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms or any applicable laws
  • Is harmful to other users, third parties, or our business interests
  • Exposes us to legal liability

12.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service immediately ceases
  • We may delete your account and all associated data
  • You remain liable for any obligations incurred prior to termination
  • Provisions that by their nature should survive termination shall continue to apply

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Enduro Book regarding the Service and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or failures of third-party services.
